Terms and Conditions

  1. To the fullest extent permitted by law, we do not accept liability of any nature for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this Event. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, our liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again. In no event will we be liable for any indirect, consequential, exemplary or special damages.
  2. Admission is at the attendee’s own risk. Attendees acknowledge that neither we nor any venue or trade provider at the event will be responsible for any loss or damage to property (including personal property such as bags, money or other personal items) brought to or purchased at the Event by any attendees.
  3. Stallholders and attendees will be liable for any loss or damage caused at the Event by you or your invitees.
  4. Attendees and stallholders must ensure that you and your invitees act in an orderly manner when attending the Event. We may refuse entry or evict you or any of your invitees if they are behaving in an intoxicated, disorderly, offensive, threatening or inappropriate manner, towards any person.
  5. The Event is open to all ages. Children under the age of 12 years that attend the Event must be supervised by a responsible adult at all times. Children who behave in a disorderly, disruptive or inappropriate manner may at the sole discretion of the Event organisers be required to leave the Event site.
  6. We reserve the right to add, withdraw, reschedule or substitute exhibitors and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.
  7. Stalls and activation space cannot be transferred, sublet, franchised or sold to any other person, nor can they be shared without written approval from management. You do not own a space at 'SouthFest'.
  8. You agree to not facilitate any stalking, harassing or being nasty to exhibitors, sponsors, stallholders or attendees and posting private contact details of other participants. Failure to do so will result in possible cancellation of your application and future applications. 
  9. Sample giving and tasting is encouraged, within food safety limits. Any produce being sold as ‘organic’ must have, and display, proof of certification. All produce must be clearly labelled and clearly priced. Produce should be offered at fair, market - driven prices that reflect the quality and/or specialty nature of the goods sold.
  10. You cannot on-sell another food product made by someone else unless pre-approved to do so.
  11. No early pack up is ever permitted. Stall holders and exhibitors must remain open for the length of the SouthFest event. 
  12. For stall holders, only products listed and approved by the management on the current application may be sold. If you wish to add new items to your stall, a request in writing, with photos must be approved by management. This list is kept on file and will be used for spot checks. 
  13. All stallholders must present their stalls in a professional, safe and clean manner. Any boxes/packaging/suitcases etc must be hidden from view and not impose on neighbouring stallholders' displays. 
  14. Stallholders are responsible for leaving their site and surrounding area clean and tidy. Boxes and cartons must be removed from the market area. Please do NOT use SouthFest general bins – industrial bins are located on site. We have significant numbers at SouthFest and the bins are for general rubbish. If you are found to be leaving other rubbish you may not be offered another spot at SouthFest in the future.
  15. Stallholders must confine their displays to their allocated space. Signs and displays must be within this area. Please keep pathways clear for event attendees.
  16. It is the responsibility of the stallholder to ensure they conform to Australian Standards, ACCC, pertaining to their product. SouthFest will not be held accountable for any trademark, copyright or safety infringement.
  17. Loud product promotion by stallholders is not permitted where it will impact in a negative way on other stallholders or event attendees. 
  18. The stallholder must have read and understood the mandatory safety standards applicable to their products and labelling. You can check this at http://www.accc.gov.au.
  19. Stallholders must have their stall set up completed by 10am on the day of the event.
  20. SouthFest has the right to reject any stallholder whom they believe does not comply with the terms and conditions as stated or fit with the vision and objective of SouthFest.
  21. Southfest has the right to withdraw the right of trade of any stall holder in dispute with SouthFest or any persons. Right to trade will be on reinstated if the dispute is resolved to Management satisfaction. SouthFest does not accept any responsibility for costs incurred by any stallholder in dispute with SouthFest (this includes advertising, accommodation and equipment hire) if their offer to trade at the SouthFest has been withdrawn.
  22. SouthFest reserve the right at any time, to change the venue and date of the Event. In the event of a change, we will publish details on the SouthFest 2018 website.
  23. The right of admission is reserved and is subject to the SouthFest Management and the venue’s terms of admission, copies of which are available from SouthFest Management on request.
  24. It may be a condition of entry to the Event that a search of your person and/or your possessions and motor vehicles is required at the time of entry to the venue. GLASS, ALCOHOL, WEAPONS, ILLEGAL SUBSTANCES or any item the Event organisers consider may be used in an illegal or offensive manner may be confiscated. Refusal to consent to a search WILL prevent entry to the Event, without refund.
  25. Entry is at own risk and the right to refuse entry is reserved. The event organising committee or venue shall not be held liable for any loss, injury or damages sustained entering on the site – to the extent allowed by the law.
  26. The whole venue is a GLASS FREE ZONE and no glass shall be brought into any part of the venue including the car park. Please do not bring glass into the Event, broken glass and event do not mix, consider your fellow humans feet. Exception will be had for glass products sold at the event.
  27. Some parts of the event will have licenced operators selling alcohol. Any patron wishing to consume alcohol must have photographic ID. We reserve the right to evict patrons who disobey or break Responsible Service of Alcohol legislation and the law.
  28. Anyone found supplying or buying alcohol for a minor will be evicted from the Event and will face criminal charges.
  29. Anyone found supplying or consuming illicit drugs will be evicted from the premises and face criminal charges.
  30. Certain areas within the Event venue may be smoke free zones. Smoking will not be permitted within the confines of these specific areas at the venue.
  31. Trading signs or other signs are not permitted without prior consent of the SouthFest Management.
  32. Footwear must be worn at all times on the site.
  33. Animals are not permitted, except in accordance with legislation.
  34. Fires and fireworks are not permitted.
  35. This agreement is governed by the laws of Australian Capital Territory.
  36. Any breach of any of these terms and conditions will entitle the Event organisers to evict offenders without any form of compensation. 
  37. SouthFest Management cares for the environment and community. Please be respectful and place any litter in the recycle or other bins provided around the venue. Be waste and water wise – thank you.
  38. Please respect the venue and neighbors and do not create excessive noise or litter while travelling to and from the Event. 
  39. All stallholders must respond promptly and respectfully to the direction of SouthFest staff and volunteers and must not undertake any action that places the safety of the event site at risk.
  40. All stallholders must have a representative attend an advertised site bump in and site safety briefing prior to/or as soon as arriving on site.

Refunds

  1. We reserve the right to cancel or postpone the Event for any reason. In the event of the cancellation in advance of the Event, we will provide a refund only to those who have purchased vendor sites less an amount to cover administration costs. 
  2. Sponsors should refer to their individual sponsorship agreement for a policy on refunds.
  3. Stallholders, vendors and exhibitors can opt to cancel their registration with notice in writing to the SouthFest Organising Committee up to 6 weeks before the event less an amount to cover administration costs.
  4. Stallholders, vendors and exhibitors who cancel within 6 weeks of SouthFest will not be entitled to a refund of any kind.
